There is no first aider on our shift. Is this legal?

I work nights and there are 40 of us in the factory but no trained first aider. Last week someone fainted and nobody knew what to do.

Under the Health and Safety (First-Aid) Regulations 1981, employers MUST provide: - Adequate first aid equipment and facilities - An appropriate number of trained first aiders (based on workplace risk and number of employees) - A first aider present at all times during working hours For a higher-risk workplace like a factory with 40+ workers, there should be at least 1 trained first aider per shift.
